Payment Terms

  1. What are the monthly or periodic payment obligations?
  2. When is the final principal payment due?
  3. Is there a right to extend the loan?

  2. Are there ongoing fees for the life of the loan?
  3. Were you charged what you were quoted on the Good Faith Estimate?

Representations and Warranties of the Borrower

  1. Due orgnization of the borrower?
  2. Duly qualified to do business?
  3. Authorization to do the loan?
  4. Enforceability of the loan?
  5. No litigation?
  6. Compliance with laws?

Conditions to close

  1. Execution of all required documents
  2. Certified copies of Board resolutions approving the loan
  3. Good standing certificate;
  4. Estoppel from association;
  5. Approval by the Association;
  6. Is the association in arrears;
  7. Borrowers has complied with all covenants;
  8. No adverse change by borrower;
  9. Completion of due diligence by the lender.
