One option to cancel credit card debt is settlement.  A settlement of credit card debt requires first ascertaining that the amount being charged is correct, and then negotiating down the balance, including forgiveness and then payment to cancel the balance.  Many credit card companies threaten suit or jail and often do not even have correct balances. That is why it is of utmost importance to make sure the starting number is accurate.

Another option to cancel credit card debt is a payment plan, again reducing the starting balance, and then agreeing to payoff the short balance within 12 or 24 months.

Once a credit card suit is filed, or worse, a judgment is entered against  you for the debt owed, the creditor can now freeze your bank accounts,  repossess a  car, or garnishment your wages.  Often, creditors who hire attorneys do not even properly serve defendants with the credit card debt lawsuit, causing the debtor o not even know a suit is filed against them until its too late. This is both illegal and unconstitutional and the judgment can be vacated and dismissed.

AIRBNB – SHORT TERM RENTALS PERMITTED IN FLORIDA

The City of Miami, trying to ban short term AIR BNB rentals, was sued by AIRBNB recently, stating that the ban violated Constitutional rights.  Well,  a Miami  Judge agreed with AirBNB, and felt that this lawsuit was not merited and  temporarily blocked Miami’s city government from going after thousands of Airbnb hosts accused of illegally renting their homes by the day and week.

Judge Beatrice Butchko issued a temporary restraining order late Wednesday that bars Miami’s code compliance department from enforcing the city’s short-term rental ban in City of Miami residential neighborhoods. In issuing her order, Judge Butchko,  ruled “that the city was preempted by state law from enforcing its policy.” Source:  The Miami Herald.  “On behalf of our Miami host community, we are grateful to the Court for giving this important matter immediate attention,” Airbnb said in a statement. “We are hopeful that it will result in relief and fair treatment for the 3,000 Miamians who responsibly share their homes on Airbnb.”

While this temporary ban is now in place, many tenants have gotten into trouble with their own Landlords, and further raised violations for the landlord with certain homeowner associations that ban short term or Airbnb rentals.  It is crucial as a tenant to make sure that one, your residential lease permits “subleasing”, or renting to another person and that the property or association permits short term rentals.  By not doing so, you could find yourself evicted and facing thousands of dollars in violations and damages.

LOAN MODIFICATION AFTER HAMP – THE NEW FLEX MODIFICATION

While the Making Home Affordable Program may have fizzled out on December 31, 2016, there is a new loan modification program, the FLEX Modification or Flex  Loan Modification, being offered by Fannie Mae and Freddie Mac.   Effective as of February 1, 2017 but not being considered until May 1, 2017, this new program was rolled out by Fannie Mae  and Freddie Mac, to help those that are in default on their mortgage or in imminent default (not yet behind but about to be).

While the Flex Modification is somewhere between the Freddie Mac Standard and Streamlined Modifications, there are a few significant changes worth noting:

  • Can be applied to all mortgage loan delinquencies
  • The program will offer additional payment relieve allowing forbearance of principal up to an 80% mark to market loan to value ration for eligible borrowers.
  • For borrowers more than 90 days past due on their mortgages, the  program targets a 20% payment reduction and requires no borrower documentation.

The new Flex Modification will replace the current Fannie Mae Standard and Streamlined loan modifications on or after October 1, 2017, meaning those programs will no longer be available.

Evaluation and qualification for this new loan modifications program still is key.  Therefore, if you are facing a mortgage foreclosure due to inability to pay or a mortgage loan default, it is important to speak to a knowledgeable attorney who can determine  your eligibility and qualifications. The Florida Legislative Foreclosure Act, while helping the banks out more than the borrowers, did one positive thing.  It limited the time period when a bank can go after a borrower for the balance of the mortgage after the foreclosure.  This is called the deficiency.
