A RECENT NEVADA SUPREME COURT DECISION THAT ALLOWS HOMEOWNERS ASSOCIATIONS TO TRUMP MORTGAGE LENDERS IN FORECLOSING ON HOMES SENT A SHOCK WAVE THROUGH THE MORTGAGE INUDSTRY LAST WEEK.  THE RULING IN ESSENCE ALLOWS HOMEOWNERS ASSOCIATIONS TO SELL A PROPERTY TO THE HIGHEST BIDDER, FOR EXAMPLE $3,000, $4,000 OR $5,000 AND EXTINGUISH THE DEBT A MORTGAGE LIEN HOLDER HAS, WHICH IN THE NEVADA CASE WAS $885,000.00

THE NEVADA CASE CENTERED AROUND A $6,000 DEBT OWED TO THE HOA.  THE BANK WAS OWED $885,000.00 HOWEVER, AFTER SELLING AT AUCTION FOR $6,000.00, THE COURT RULED THAT THE SUPER PRIORITY LIENS HELD BY HOA’S FOR UNPAID ASSESSMENTS TAKE PRECEDENCE OVER FIRST TRUST DEEDS HELD BY BANKS OR OTHER MORTGAGE LENDERS.  THE NEVADA COURT FURTHER HELD THAT HOA’S DO NOT NEED TO GO THROUGH THE COURT SYSTEM TO SEIZE THE PROPERTY.   THE RULING ALLOWS HOA’S TO LEGALLY FORECLOSE ON THE PROPERTY BY SELLING THE PROPERTY AND EXTINGUISHING THE DEBT.

WHILE THE LAW COMPELS HOMEOWNERS TO PAY THEIR DUES AND ASSESSMENTS TIMELY TO THE HOA, THIS LEAVES THE BANK’S HOLDING MORTGAGES HIGH AND DRY TO FORECLOSE THE PROPERTY TO SATISFY THE DEBT. LENDERS VIEW THE DECISION AS A RECIPE FOR DISASTER, SINCE IT WILL SET THE PRECEDENT FOR OTHER STATES TO DO SAME.

IF FLORIDA WERE TO FOLLOW SUIT,  HOMEOWNER ASSOCIATIONS THAT HAVE DELINQUENT MAINTENANCE AND ASSESSMENTS AND NEEDED TO COLLECT, COULD SIMPLY SELL THE PROPERTY TO SATISFY THE LIEN AMOUNTS DUE THEM, AND MORTGAGE DEEDS OF TRUST WOULD BE EXTINGUISHED.

THE  NEW LAW GIVES THIRD-PARTY INVESTORS A HUGE WINDFALL SINCE PURCHASING PROPERITES FROM AN HOA WITH MORTGAGES, SOMETIMES TWO MORTGAGES, IS A SHORT TERM WIN.  ONCE THE MORTGAGE WAS AUCTIONED IN FORECLOSURE, THAT LIEN BEING CONSIDERED SUPERIOR IN FLORIDA COURTS, TRUMPED THE CERTIFICATE OF TITLE TO THE INVESTOR, CAUSING THEM TO LOSE THEIR INVESTMENT.

IT REMAINS TO BE SEEN THE LONG TERM EFFECTS THIS WILL HAVE FOR NEVADA HOA LIENS AND FORECLOSURE LAW AND WHETHER FLORIDA AND OTHER STATES WILL FOLLOW SUIT.

Struggling private student loan borrowers, who have gone into default, and having trouble making ends meet, have options.  The Consumer Financial Protection Bureau, who has studies 5,300 private student loan complaints, have reported that of the over 5,000 loans analyzed during a one year period, complaints rose by more than 37 percent, most of them centered on lack of options available for modifying the loans.  The bulk of the complaints were centered on:

1.   Borrowers unaware that they had options to lower the payments or restructure their debt.

2.  Borrowers not yet earning sufficient income, and having a large balance due all at once.

3.  Borrowers complaining that servicers did not offer repayment plans, or forbearance plans that required a larger payment when the balance became due.

While forbearance typically ends one or two years after graduation, the interest rates of yesteryear, 1% and 2% are just that, a thing of the past.

Todays students face 4, 5 and even 6 percent interest when in reality, just starting out in the workforce, they are making half of their expected salary.

According to the Consumer Financial Protection Bureau, more than 7 million Americans are currently in default on student loans, totaling more than 1.2 trillion in outstanding loan debt.

To combat this, student loan companies are offering their borrowers options to avoid default.  Options consist of:

  • Debt restructuring
  • Lower payments due on financial analysis of income/expenses of individual borrower
  • Longer amortization schedules – extending life of the loan

 

Default in student loans, which results in derogatory information on the student borrowers credit score,  has a lingering affect, catapulting into hurting the borrowers chances when applying for a job, obtaining a loan for housing, or renting, and so many other effects.

If your first mortgage was modified or in the process of being modified, and you have  a second mortgage on the property, either HELOC or other type of loan, the Obama Administration has created numerous programs to assist with eliminating the debt on these second mortgages.  Often, a homeowner is upside down and the options are limited, however under the Second Lien Modification Program relief exists.

  • Second Lien Modification Program (2MP)  –  This allows eligible homeowners who are upside down on their mortgage, and owe more on the property then the home is worth, to reduce the mortgage debt to the 2nd mortgage under the HAMP program.

 

  • Treasury/FHA Second Lien Program –  This program is for homeowners with second mortgages whose first mortgage servicers agrees to participate in the FHA Short Refinance- to reduce or eliminate the second mortgage all together.  The total amount of mortgage debts after the refinance can not exceed 115% of the homes current value.

 

  • PRA or Principal Reduction Program – Another program designed to help homeowners whose homes are worth less then they owe, to reduce the balance owed.

 

  • Home Affordable Unemployment Program (UP)   – This program was designed for homeowners that have lost their jobs and became unemployed and unable to make mortgage payments.  UP provides temporary reduction or suspension of mortgage payments, at least 12 months, while the homeowner is seeking reemployment.

 

  • HAFA – Lastly, the program for homeowners who do not wish or simply can not keep their homes. This is the short sale under the Making Home Affordable that can offer relocation assistance to homeowners and extinguish the debt on a first and/or second mortgage.

Way Signs "Bailout - Collapse"The Making Home Affordable Program is Obama’s way of helping homeowners avoid foreclosure.  Homeowners that are eligible, can “lower their monthly mortgage payments and get into stable loans at today’s low rates.  And for those homeowners for whom homeownership is no longer affordable or desirable, the program can provide a way out which avoids foreclosure.”

If you wish to modify or refinance your loan, the HAMP program can:  Lower your monthly payment to 31 percent of  your monthly gross pre-tax income.  “The typical HAMP modification results in a 40 percent drop in a monthly mortgage payment.”

You may also qualify for loan forgiveness or principal reduction for homeowners whose houses are underwater to reduce the amount you owe on your home.

You  may further be eligible for a Second Lien Modification (2MP). If your first mortgage was permanently modified under HAMP and you have a second mortgage on the same property, or a HELOC, 2MP works together with the HAMP on the first,  to provide solutions to make the home affordable.

To be eligible for 2MP you must have a first mortgage modified under HAMP, must not have been convicted of any felony in the last 10 years and must not have missed three consecutive mortgage payments under the HAMP modification of your first loan.

This eligibility criteria is for guidance only.  Additional qualification and approval is required by your lender.

There is also the HARP program for borrowers that are current on their mortgage but unable to obtain a traditional refinance because the property is underwater without no equity.  This program is designed to help refinance and make the mortgage, including interest rate, more stable.

???? Vol.5 ??????According to data released from  HOPE NOW, approximately 421,000 homeowners used non-foreclosure solutions from mortgage servicers in the second quarter of 2014. Non-foreclosure solutions take the form of loan modifications, short sales, deed in lieu of foreclosures and other loss mitigation options. The number of non-foreclosure solutions in 2014 Q2 was almost quadruple the number of foreclosure sales for the same period.

The most popular loan foreclosure solution is of court the loan modification, which approximately 116,000 borrowers utilized.  Short sales accounted for 33,000 and deeds in lieu of foreclosure  7,561.

Banks are more than eager to work with borrowers to workout mortgage defaults and get the borrowers back on track.  A loan modification under HAMP, the Making Homes Affordable Program, typically take between 90 to 105 days to process and obtain a trial period.  The most important factor of submitting a HAMP request is to make sure the numbers qualify the borrower for a modification.

Submitting packages blindly, without qualifying the borrower is a huge injustice to the homeowner that wants to keep their home.  There are often the modifications that take 6 to 9 months to process, since the packages may be missing financial information or the ratios under HAMP were not correct.

Another important consideration is knowing whether your loan is Fannie Mae or Freddie Mac backed, which will determine whether you are eligible for principal reduction.

Short sales on the other hand, specially under HAFA, also have strict guidelines that if the borrower is not qualified before submitting, could turn into a 9 to 12 month order with no end in sight.  Lenders quickly deny short sales where financials are missing or contracts have incorrect information.  The scope of knowledge by the preparer and negotiator is so important to determining the final decision for the lender, on whether to approve or deny a loss mitigation request.

Way Signs "Bailout - Collapse"BANK OF AMERICA ANNOUNCED THURSDAY THAT IT HAS AGREED TO SETTLE AND $16 BILLION FOR ALL THE TROUBLE IT CAUSED IN THE MORTGAGE FINANCIAL CRISIS.  THE SETTLEMENT IS THE LARGEST CIVIL SETTLEMENT WITH A SINGLE ENTITY IN THE HISTORY OF THE UNITED STATES.  SOURCE:  DS NEWS

ACCORDING TO THE SETTLEMENT, BANK OF AMERICA HAS AGREED TO PAY $9.65 BILLION IN CASH TO THE JUSTICE DEPARTMENT, VARIOUS FEDERAL REGULATORS, AND THE STATES OF CALIFORNIA, DELAWARE, ILLINOIS, KENTUCKY, MARYLAND AND NEW YORK.

THE REMAINING $7.0 BILLION WILL BE PAID IN THE FORM OF CONSUMER RELIEF INCLUDING MORTGAGE MODIFICATIONS, COMMUNITY STABILIZATION, AND LOANS TO LOW AND MODERATE INVOME COMMUNITIES.

THE AGREEMENT RELEASES BANK OF AMERICA FROM ALLEGATIONS THAT IT WAS INVOLVED IN THE MORTGAGE FINANCIAL CRISIS, THAT IT WAS AWARE THAT THE LOANS IT GAVE WERE BAD AND THAT IT KNOWINGLY MISREPRESENTED MORTGAGES WHEN THEY WERE SOLD. IT ALSO RELEASES THE LENDER FROM VIOLATONS OF UNDERWRITING GUIDELINES MADE BEFORE THE MORTGAGE CRISIS.

IN A STATEMENT, BANK OF AMERICA ANNOUNCED THAT THE MAJORITY OF THE CLAIMS STEMMED FROM CONDUCT THAT OCCURRED AT COUNTRYWIDE AND MERRILL LYNCH BEFORE ITS ACQUISITION OF THE TWO COMPANIES.

WHILE CERTAINLY A BANDAID IN THE WHOLE MORTGAGE FIASCO, THIS SETTLEMENT IS GOOD NEWS FOR CONSUMERS WHO ARE LOOKING TO BANK OF AMERICA FOR LOAN MODIFICATIONS AND SHORT SALES. IT MEANS THAT BANK OF AMERICA WILL MOST LIKELY COOPERATE TO THE FULL EXTENT IN ORDER TO HAVE SUCH OPTIONS APPROVED.
