SOUTH FLORIDA DEBT SETTLEMENT LAWYERS
FORECLOSURE DEFENSE  ATTORNEYS

If you live in Florida, or any of the States affected by Hurricane Irma, and  requested a forbearance back in September, you may have noticed that many banks did not honor their deals.  Many banks verbally confirmed with borrowers that they could delay payment of their mortgage payments, some for six months, and that there would be no interest or late fees charged.  However, when many borrowers receive a mortgage statement six months later, asking for the full amounts due, plus late fees and interest, many borrowers find themselves in a predicament, unable to make the payments.

Instead of assisting borrowers and homeowners with their mortgages after a natural disaster, many lenders are quickly filing foreclosures, and not honoring defaulted loan modifications under the Making Home Affordable Program.  Lenders such as Carrington Mortgage and PNC are two of them.

If you have received a default notice or your bank has not honored the terms of the mortgage forbearance, there is hope.

At the Law Offices of Jacqueline A. Salcines PA we have a great success rate negotiating the past due mortgages and forbearances with lenders.  Attorney Jacqueline Salcines has over 18 years experience negotiating debt settlements for our clients, including violations of the Fair Debt Collection Practices Act.  You do not have to file for bankruptcy in order to get out of this Dyck O’Neal debt.  Allow us to go to work for you and negotiate your debt.

We offer free phone consultations, and a no cost review of your case.

MIAMI DADE LOAN MODIFICATION

 FORECLOSURE ATTORNEYS

While the Making Home Affordable Program may have fizzled out on December 31, 2016, there is a new loan modification program, the FLEX Modification or Flex  Loan Modification, being offered by Fannie Mae and Freddie Mac.   Effective as of February 1, 2017 but not being considered until May 1, 2017, this new program was rolled out by Fannie Mae  and Freddie Mac, to help those that are in default on their mortgage or in imminent default (not yet behind but about to be).

While the Flex Modification is somewhere between the Freddie Mac Standard and Streamlined Modifications, there are a few significant changes worth noting:

  • Can be applied to all mortgage loan delinquencies
  • The program will offer additional payment relieve allowing forbearance of principal up to an 80% mark to market loan to value ration for eligible borrowers.
  • For borrowers more than 90 days past due on their mortgages, the  program targets a 20% payment reduction and requires no borrower documentation.

The new Flex Modification will replace the current Fannie Mae Standard and Streamlined loan modifications on or after October 1, 2017, meaning those programs will no longer be available.

Evaluation and qualification for this new loan modifications program still is key.  Therefore, if you are facing a mortgage foreclosure due to inability to pay or a mortgage loan default, it is important to speak to a knowledgeable attorney who can determine  your eligibility and qualifications. You certainly do not want to waste time thinking you qualify, risk foreclosure, only to be turned down by your lender.

At the Law Offices of Jacqueline A. Salcines, P.A., our lead real estate attorney brings over 17 years experience in the foreclosure, mortgage and real estate field as well as 22 in the accounting field. Ms. Salcines has been helping homeowners in foreclosure for over 10 years and is available by email to answer all your questions and concerns, without ever charging a consultation fee.

MIAMI DADE LOAN MODIFICATION

AND FORECLOSURE ATTORNEYS

Interest rates on the Making Home Affordable mortgage loan modifications have risen, where some borrowers are now facing hikes of 1% or 2%. A mortgage that was modified in 2009 under the Making Home Affordable Program and had a fixed interest rate of 2% in 2015, may now be at 3 or 4 % in 2017. With limited opportunities to refinance due to credit reporting problems due to the derogatory information for a mortgage loan default, borrowers are up against the wall. They may not have sufficient equity or credit rating to refinance and may not have equity to sell.  So what does a borrower do?

While the  Making Homes Affordable Program may have expired to submit a loan modification (the last date for submission was December 30, 2016 and has not been extended by the Trump or Obama Administration) programs still exist for loans modification if your mortgage is  owned by Fannie Mae, Freddie Mac, Veteran Affairs or the USDA.  Loan Modification Programs include interest rate reductions and often principal forgiveness.  Even if your loan is not Fannie Mae or Freddie Mac, your lender may still be willing to work with you.  Just not a loan modification under the Making Home Affordable Program unless it gets extended.

Lenders continue to be understandable and are allowing homeowners to enter into loan modifications and modify their mortgage and loans under these programs that continue to exist into 2017.

If you are facing a mortgage foreclosure due to inability to pay or a mortgage loan default, there are options for a loan modification.

While the  Making Homes Affordable Program may have expired (the last date for submission was December 30, 2016 and has not been extended by the Trump or Obama Administration) programs still exists if your loan is owned by Fannie Mae, Freddie Mac, Veteran Affairs or the USDA.  Programs include interest rate reductions and often principal forgiveness.

These lenders continue to be understandable and are allowing homeowners to remodify their mortgage and loans under these programs that continue to exist into 2017. Many borrowers under the HAMP program had adjustable rates which increase after the 5th year.  That would put anyone that modified their loan in 2009 or 2010 into a higher interest rate.  A mortgage default however doesn’t mean you have to lose your home. A Miami Dade Loan Modification attorney at our firm can help.  However, with a deadline of December 30, 2016 to submit, the Making Homes Affordable Program may no longer be available but others are.

There are strict eligibility requirements under these programs,  and it may be necessary to make sure you qualify before submitting a modification request, we are here to help.  At the Law Offices of Jacqueline A. Salcines, PA, we are Miami Dade Loan Modification attorneys and keenly aware of the requirements and are able to sit with the borrowers, review their financials data, and provide solutions for their homeownership mortgage problems.  Allow my team of attorneys and accountants to go to work for you so you do not fall victim and lose your home.

Now that the deadline to submit a Home Loan Modification request under the Making Homes Affordable Program has expired (the last date for submission was December 30, 2016 and has not been extended by the Trump or Obama Administration) what will happen with all the borrowers who are again struggling to pay their mortgages?  While the program has not been keyed for renewal, like the HARP program that was extended, borrowers face a myriad of questions and concerns as to what will happen with their underwater properties.  Loan Modifications continue to prevail with other plans that are available.  Fannie Mae, Freddie Mac, FHA Federal Housing Authority and even the USDA have programs that continue to exist to help underwater home loan borrowers with their default and delinquent mortgages.

Lenders continue to be understandable and are allowing homeowners to remodify their mortgage and loans under these programs that continue to exist into 2017.

HELOC loans, or Home Equity Lines of Credit, are great loans for helping with closing costs at the time of purchase, or for helping pay for vehicles, or house repairs, or any emergency.  However, when the balance of your first mortgage exceeds the fair market value of your home, or the first and HELOC added together total more than your home is worth, HELOC’s become not so fun and endearing.  In fact, many homeowners want to knock themselves over the head for taking them out and now having to be stuck in an underwater property.

But, what many borrowers do not know if the hidden secret behind HELOC’s and the lenders who hold them.

At the beginning the HELOC’s have very low interest rates, or are interest only, causing only a $200 or $250.00 dent in the borrowers pocketbook. But as the amortizing HELOC’s now reach maturity or rate adjustments, homeowners are finding themselves unable to make the payments.

That’s where we come in.

ORDER AN APPRAISAL AND KNOW WHAT YOUR HOME IS WORTH

If the home is upside down, meaning you owe more than its worth (with both mortgages added together), the majority of lenders will not foreclose or even attempt collection efforts, since they know they are in second position of priority.   Therefore, the solution here is settlement.  Not modification.

At the Law Offices of Jacqueline Salcines, PA, we handle hundreds of these second HELOC mortgage negotiations and have experience in settling them. By first ordering the appraisal and a payoff of the first mortgage, we know how to approach the lender to make a case for 100% settlement and write off of the HELOC loan.  Often lenders have faulty assignments, have lost notes, and the debt is uncollectable merely because they don’t have the documents to pursue the foreclosure collection in court.   When these scenarios arise, the majority of the lenders will agree to this position and sign a Satisfaction of Mortgage and release of the lien.

SETTLEMENT OPTIONS

If not agreeable, then they may still settle for pennies on the dollar, again not a modification!  A loan settlement means that they may agree to accept $1,500.00 or $2,000.00 on a loan of $150,000.00 or $200,000 (10 percent to the total debt owed)  And the remainder is not paid in installments. Rather, it is completely erased and forgiven.  So the only remaining loan on the property is the first mortgage.

At the Law Offices of Jacqueline A. Salcines, PA, we have extensive, over 25 combined years experience in navigating through mortgage, real estate and debt settlement law to get the possible results for our clients.  HELOC loans can be troublesome.  But we can help you navigate through the maze of homeownership and HELOC’s.  Knowing  the type of loan settlement you can qualify for and whether the servicer participates is our job.

Allow us to put our knowledge and expertise to work for you.  The first consultation is always free of charge and can determine, after careful examination of the above details, provide options available to you.   Call today.
