Mortgage rates are at an all time low. Some mortgage lenders are even coming up with creative ways to refinance, including 12 year mortgages and zero cost refinances.

In a refinance, a mortgage lender will typically loan up to 80% of the fair market value of your property. That means that whatever the mortgage balance you have today is, the value of your property is what will be the determining factor as to whether you can refinance or not.

In a refinance, the current mortgage loan is cancelled and replaced with a new loan. The reasons for refinancing are to get a better interest rate, better mortgage terms, remove someone from a mortgage or to cash out on the value of the property, so that you can make necessary repairs or even pay off credit card debt. The bank does not limit what you can do with the additional monies and often times borrowers can even use it to purchase other real estate.

In order for a refinance to make sense however, the amount you save, over the life of the loan should be greater then the closing costs associated with the refinance.

Title Companies in South Florida are required by law, to give you a reissue credit, or a reduced fee off the title insurance premium, on a refinance. While many borrowers arent even aware they have the absolute right to choose their own title company to handle the closing, they often allow the bank to choose it for them, which results in higher fees and costs at closing and no reissue credit.

What happens to escrows, or monies held by the mortgage company for insurance and taxes after a closing when the property is sold?  Mortgage escrows are funds paid by the borrower when making their monthly  mortgage payment, for the payment of insurance and taxes on the yearly anniversary dates.  These monies belong to the homeowner or borrower and are held in reserve until the bank pays them.

Once a real estate closing takes place and the mortgage is paid off, what happens to those monies?  The bank is not paying taxes or insurance and therefore, the monies will not be paid to any third party company.

The monies advanced for escrows are then required to be returned by the lender, within a date certain. Borrowers are urged to advise their mortgage companies of their correct addresses so that the checks reach them once issued and mailed.  The bank will not wire the funds or send the checks certified mail. Therefore, it is the responsibility of the homeowner to make sure the bank has their correct address.

MIAMI DADE LOAN MODIFICATION AND FORECLOSURE ATTORNEYS

Now that the deadline to submit a Home Loan Modification request under the Making Homes Affordable Program has expired (the last date for submission was December 30, 2016 and has not been extended by the Trump or Obama Administration) what will happen with all the borrowers who are again struggling to pay their mortgages?  While the program has not been keyed for renewal, like the HARP program that was extended, borrowers face a myriad of questions and concerns as to what will happen with their underwater properties.  Loan Modifications continue to prevail with other plans that are available.  Fannie Mae, Freddie Mac, FHA Federal Housing Authority and even the USDA have programs that continue to exist to help underwater home loan borrowers with their default and delinquent mortgages.

Lenders continue to be understandable and are allowing homeowners to remodify their mortgage and loans under these programs that continue to exist into 2017.

Many borrowers under the HAMP program had adjustable rates which increase after the 5th year.  That would put anyone that modified their loan in 2009 or 2010 into a higher interest rate.  A mortgage default however doesn’t mean you have to lose your home.
