Florida title to real property is held in the form of a “deed”.  There are many different types of real estate deeds. You can have a Warranty Deed for general real estate sales and purchases. When you purchase property from a developer you typically get a Special Warranty Deed.  When you purchase property from a Trust you get a Trustee Deed. And then there are Quit Claim Deeds.  Quit Claim Deeds are mere transfers of title, without any warranty or guarantee as to the title or clouds on title. For example, there may be a mortgage or lien on the property that will not be extinguished or removed when the title is transferred by quit claim deed.

The recording of a quit claim deed, while inexpensive ($10.60 in Miami Dade and $10.70 in Broward and Palm Beach County), affords the least protection to the purchaser or Grantee, and  also requires the payment of documentary stamp taxes on any outstanding mortgage(s). If not paid at the time of recording, then the transferor could face severe penalties after recording the document.

Many deeds are exempt from having to pay documentary stamp taxes,  for example, if the deed is the result of a divorce. And while many vendors such as Office Depot sell deeds, it is always best to consult a real estate attorney to prepare it for you. Any mistake, or wrong digit in the legal description of the real estate could have severe consequences, after the fact if Grantors die or disappear.

LANDLORD TENANT LAW

Whether you are a tenant in South Florida housing that is experiencing mold, or a landlord in South Florida being told by your tenant that the property has mold, the solution is not always easy.  Living in such close proximity to the water, it is almost impossible to not find a property in South Florida that does not have the presence of mold. And not all mold is dangerous, life threatening or hazardous.  However, some mold is and that is where things can get very scary.

Florida landlord tenant law is governed by Florida Statutes Chapter 83.  Chapter 83 makes the landlord responsible for providing habitable conditions in a property rented. This means air, water and conditions that do not cause health concerns. However, many residential leases contain clauses that opt out of Florida landlord tenant law Chapter 83, and the tenant signs that he accepts the property as is and that at the time of signing there is no  mold.

Many residential landlord tenant leases also require notice to the landlord and opportunity to correct the issue, which could mean calling a mold remediation company to assess the existence of mold, type of mold and remove it.  Mold also causes severe property damages when spores attach to sofas, and clothing, aggravating the situation and out of pocket damages even more.

TITLE SERVICES – TITLE COMPANY

Buyers and seller alike should always hire an attorney to represent them and their interests for a real estate closing and real estate transaction. Whether you are buying in Miami Dade County and require the title company to represent you, examine the property title, and prepare a title commitment, or you are a seller of real estate and require not only contract review and revisions, but assistance with document preparation, you must always hire an attorney.

While many states only allow real estate attorneys  to conduct real estate closings, Florida is not one of them. Therefore, many sellers opt to use the title company selected by the buyer in order to represent them. However, that opposing party title company does not represent you. They will charge a fee for document preparation, or settlement services, but at the end of the day, if there is an issue, you are on  your own.

Seller services can include contract preparation, contract review, addendums, inspections negotiations for credits, and a host of different documents required whether the seller is a trust, or a company. There are also issues relating to death of the title holder or liens on the property. 

As a buyer,  the title company will also help with contract preparation or review, run title, run lien searches and prepare closing statements.

According to the National Association of Realtors, pending home sales in Florida is down by 1.3 percent for the month of April.  This is a decline from sales last  year for the same given time.  Despite the decline however, prices remain constant, up from last year at this time.  Pending real estate home sales may be down due to strengthening of the U.S. Dollar, making some property unaffordable to buyers.  The South Florida real estate market has also experienced a dramatic rise in condominium developments, signaling a higher volume of inventory, driving some prices down.

Mortgage rates for real estate purchases continue to be at an all time low, but certified appraisals are also at an all time low, signaling delays in closings as well.

Florida Real Estate Law Firm Provides Guidance During Closing

Many participants in Florida residential real estate transactions fail to understand the closing process, but an experienced real estate attorney will help the process run efficiently, smoothly, and successfully.

Closing a Florida Residential Real Estate Transaction

After a purchase and sales contract is signed by the buyer and seller, the initial escrow deposit is made by the buyer, and a title search is requested and completed, a Florida real estate attorney will prepare all the documents necessary to close the transaction. These documents typically include:

  • Deed
  • Bill of sale
  • Affidavits
  • FIRPTA certificate (for foreign sellers)
  • Closing statement, including instructions

Once the title has been cleared and the necessary documents prepared, a date and time to close the transaction will be scheduled. At the closing, a attorney will oversee all aspects of the closing and answer any questions either party may have relating to the transaction or any of the closing documents.

The seller will sign the deed and the other seller documents, and the buyer will sign the buyer’s documents and the loan documents (if the transaction is being financed), and both parties will be required to sign the HUD-1 settlement statement. After the closing is complete, the seller, real estate agents, and other parties to the transaction are paid, and certain documents are sent to be recorded in the Florida county in which the property is located.

OCTOBER 2016 REAL PROPERTY CASE LAW UPDATES

FORECLOSURE LAW:  Debtor lost the right to defend the mortgage foreclosure action pending in state court, when it agreed to surrender the property in the bankruptcy and was required to surrender the property to the trustee and to the mortgage lender.  Failla v. Citibank, N.A., Case No. 15-15626 (11th Cir. Oct. 4, 2016) (affirmed).

FORECLOSURE AND CONDO ASSESSMENTS (SAFE HARBOR LIMITATION):  The mortgage lender, who recovered the property via the foreclosure sale, is entitled to the safe harbor limitation of liability for condominium assessments as applicable to first mortgagees under Fla. Stat. 718.116.  Brittany’s Place Condominium Association, Inc. v. U.S. Bank, N.A., Case No. 2D15-3444 (Fla. 2d DCA Oct. 5, 2016).

FORECLOSURE DEFAULT NOTICE:  Final Summary Judgment of Foreclosure reversed where Plaintiff failed to address, in its motion for summary judgment, or at the hearing on the motion, defendant’s affirmative defense that default notice did not comply with Paragraph 22 (acceleration clause).  Young v. Nationstar Mortgage, LLC, No. 2D15-1023 (Fla 2d DCA September 28, 2016) (reversed and remanded).

FORECLOSURE LAW STATUTE OF LIMITATIONS:  The trial court erred in dismissing amended complaint as barred by the Florida statute of limitations where claims asserted in amended complaint arose from same “conduct, transaction, or occurrence” as initial timely complaint.  Anderson v. Epstein, et al., No. 3D15-1050 (Fla. 3d DCA September 28, 2016 (dismissed in part, reversed in part and remanded).

FORECLOSURE/STANDING:  Plaintiff failed to establish its own standing to foreclose as substituted plaintiff, as well as standing of original plaintiff, because (1) there was no evidence  as to when indorsement was placed on note or to whom note was payable at commencement at suit, (2) testimony regarding when note was lost did not demonstrate that note was indorsed in blank to predecessor prior to suit being filed, and (3) insufficient evidence to prove a transfer of note from original lender to predecessor as a nonholder in possession with rights of a holder. Luiz v. Lynx Asset Servs., LLC No. 4D15-558 (Fla. 4th DCA Aug. 24, 2016) (reversed)

FORECLOSURE – BANKRUTPCY AUTOMATIC STAY:  Final Judgment entered day after Defendant’s petition for bankruptcy was in effect, voided the judgment, even though trial court did not have the notice of stay filed.  Citibank, N.A. as Trustee v. Unknown heirs, No. 1D15-2502 (Fla 1st DCA July 25, 2016) (reversed and remanded).
