REAL ESTATE LAWYERS – MORTGAGE LAW

Mortgage rates are at an all time low. Some mortgage lenders are even coming up with creative ways to refinance, including 12 year mortgages and zero cost refinances.

In a refinance, a mortgage lender will typically loan up to 80% of the fair market value of your property. That means that whatever the mortgage balance you have today is, the value of your property is what will be the determining factor as to whether you can refinance or not.

In a refinance, the current mortgage loan is cancelled and replaced with a new loan. The reasons for refinancing are to get a better interest rate, better mortgage terms, remove someone from a mortgage or to cash out on the value of the property, so that you can make necessary repairs or even pay off credit card debt. The bank does not limit what you can do with the additional monies and often times borrowers can even use it to purchase other real estate.

In order for a refinance to make sense however, the amount you save, over the life of the loan should be greater then the closing costs associated with the refinance.

Title Companies in South Florida are required by law, to give you a reissue credit, or a reduced fee off the title insurance premium, on a refinance. While many borrowers arent even aware they have the absolute right to choose their own title company to handle the closing, they often allow the bank to choose it for them, which results in higher fees and costs at closing and no reissue credit.

At the Law Offices of Jacqueline A. Salcines, PA we are full service title company. We can handle your refinance from beginning to end and make sure that your fees and costs are not only reduced to a minimum, but that your reissue credit is honored. This can result in thousands of dollars in savings for you.

Call the Law Offices of Jacqueline A. Salcines, PA for all your mortgage and refinance needs. We are here to help and come with over 21 years experience in the mortgage and banking industry. The first consultation is always free of charge.

DEBT SETTLEMENT – SECOND MORTGAGE AND HELOC SETTLEMENT LAWYERS

If you have a HELOC or Home Equity Line of Credit that is either in default, unpaid, past due or written off with the lender/charged off as bad debt, the lien against your property will remain there, even if the lender is not reporting it on your credit report. Often HELOC mortgages that are unpaid or in default do not engage in collection practices, but rather wait for the borrower to sell their property in order to get paid. Just because the loan is not being reported on your credit report, does not mean it does not exist, nor that the lender does not expect to be paid in full.

At the Law Offices of Jacqueline Salcines, PA we have been assisting borrowers with settling the debt owed on Second Mortgages and HELOC loans for over 21 years. We have been successful in settling these suits for pennies on the dollar since often the HELOC Second Mortgage lender does not have their documents in order ( assignments, note, mortgage), the statute of limitations has expired or there is little to no equity on the property. Calculating the Fair Market Value is a very important step in the negotiation and it is important to hire the right professional to make sure repairs, and other significant value mitigators are taken into consideration.

When looking for a professional to negotiate your mortgage debt, make sure that the lawyer has significant experience doing so. At the Law Offices of Jacqueline A. Salcines, PA owner/attorney Jacqueline A. Salcines, Esq. is not only an attorney, but she is also an Accountant and realtor, which provides the necessary tools to determine value, comparative sales and equity. With over 21 years experience in the debt settlement/mortgage industry and 26 in the Accounting business, attorney Salcines and her knowledgeable staff can help you get the best outcome for your HELOC Settlement.

The first consultation is always free and can provide meaningful advice as to how to proceed to settle your debt. Consult today.

SOUTH FLORIDA MORTGAGE AND DEBT SETTLEMENT  LAWYER

SECOND MORTGAGE – LINE OF CREDIT –  HELOC SETTLEMENTS

A HELOC, also known as a Line of Credit Mortgage or Second Mortgage is often “charged off” or appears on a borrowers credit report as “bad debt” or “charge off”. Often, borrowers wrongly assume that the mortgage is then completely forgiven or written off and not collectible.  This is not necessarily true. Often bad debt gets sold on the market and creditors, debt companies and third parties purchase it at a discount. The mortgage remains on the title to the property and is not satisfied or reflecting a zero balance.

At the Law Offices of Jacqueline A. Salcines, PA, we have over 20 years experience negotiating debt for our clients and have been successful in wiping these HELOC and Lines of Credit Mortgages off or settling them for pennies on the dollar. The most important step and first step is to make sure the debt was transferred to the new owner correctly and that it is in fact collectible. You do not want to settle or work something out on a debt that was never collectible to begin with.

Once we determine it is collectible, then we go to work to have it worked out whether written off or settled for the borrower.

If you have a HELOC or Line of Credit mortgage sitting on your credit report or property, or have been sued in foreclosure recently to collect on the line of credit, call us.

SOUTH FLORIDA REAL ESTATE MORTGAGE LAWYERS

With the South Florida market experiencing a boom in sales and values, there is more great news to assist qualified buyers with their real estate purchases.  Starting January 2018, FHFA has increased the conforming loan limits for Fannie Mae and Freddie Mac conventional loans.  This means that the limits to purchase, prior to  the mortgage being considered a jumbo loan, are higher.

Starting on January 1, 2018, the loan limits for conventional loans has increased from $424,100 to $453,100.

With house prices on the rise, this is great news for buyers looking to finance their purchases.

Real Estate Buyers now have more purchase power under conventional funding.  And current or prior qualified jumbo pre-approved buyers and borrowers may qualify for traditional financing now, possibly at a lower interest rate and a lower down payment.  This equates in more opportunities to close on those real estate deals for realtors and sellers alike.

Don’t go it alone.  Always hire the services of a qualified real estate attorney owned title company to assist you in your real estate purchase and to help navigate all the confusing mortgage terms and conditions.

Whether you are buying real estate and require a mortgage or buying cash, before you sign the contract, reach out to us. We are here to help.  We offer a free legal consultation regarding your real estate contract, purchase or sale.

With over 18 years experience practicing real estate law, and holding dual licenses of both lawyer, realtor and accountant,  allow attorney Jacqueline A. Salcines to guide you.

We are a full service title company and handle closings from beginning to end.

MORTGAGE LAW

By now you have to be living in a cave to not have heard of Mr. Cooper.  Nationstar, the nations largest non-bank  mortgage servicer has spent millions rebranding itself, in the heels of its $20 million  loss last quarter, in order to reinvent itself.  The massive rebranding of this nonbank has left millions of homeowners wondering Who Is Mr. Cooper?

The Mr. Cooper transition, which took place weeks ago, is actually all about reimaging. The company is trying to create a more friendly, more customer oriented experience for its consumers.  Its employees are taking more than “50,000 hours of incremental customer experience training in order to ensure that everyone is equipped with the tools and resources needed to deliver the Mr. Cooper Promise. “

What does that mean for the consumer, or borrowers who had loans and mortgages with Nationstar?  Frankly,  not much.  You will now be receiving statements with the Mr. Cooper logo on the top left and when calling the servicer, the name will have changed, and hopefully after all this effort, the customer service as well.

Handling thousands of real estate closings, loan modifications and short sales for our clients over the years, Nationstar was “not very easy to deal with”.  Often you would get pushed around from one representative to another one. Get hung up on. The whole process was very frustrating. Specially when dealing with time crunches for foreclosures or trials for our clients.

When you receive the new statement in the mail from Mr. Cooper, and  you too are confused, don’t worry.  All your mortgage terms will remain the same.  Just the name will have changed.

If you have any questions about a loan modification or are purchasing or selling real estate, give us a call.

With offices in Coral Gables, we have been helping borrowers for over 18 years with their mortgage and real estate needs.  The Real Estate Law Firm of Jacqueline A. Salcines is here to guide you.

We are a full service title company and handle closings from beginning to end.

MIAMI DADE LOAN MODIFICATION AND FORECLOSURE ATTORNEYS

Now that the deadline to submit a Home Loan Modification request under the Making Homes Affordable Program has expired (the last date for submission was December 30, 2016 and has not been extended by the Trump or Obama Administration) what will happen with all the borrowers who are again struggling to pay their mortgages?  While the program has not been keyed for renewal, like the HARP program that was extended, borrowers face a myriad of questions and concerns as to what will happen with their underwater properties.  Loan Modifications continue to prevail with other plans that are available.  Fannie Mae, Freddie Mac, FHA Federal Housing Authority and even the USDA have programs that continue to exist to help underwater home loan borrowers with their default and delinquent mortgages.

Lenders continue to be understandable and are allowing homeowners to remodify their mortgage and loans under these programs that continue to exist into 2017.

Many borrowers under the HAMP program had adjustable rates which increase after the 5th year.  That would put anyone that modified their loan in 2009 or 2010 into a higher interest rate.  A mortgage default however doesn’t mean you have to lose your home. A Miami Dade Loan Modification attorney at our firm can help.

There is Hope and Help for these borrowers.  While there are strict eligibility requirements under these programs,  and it may be necessary to make sure you qualify before submitting a modification request, we are here to help..

At the Law Offices of Jacqueline A. Salcines, PA, we are Miami Dade Loan Modification attorneys and keenly aware of the requirements and are able to sit with the borrowers, review their financials data, and provide solutions for their homeownership mortgage problems.  Allow my team of attorneys and accountants to go to work for you so you do not fall victim and lose your home.

At the Law Offices of Jacqueline A. Salcines, P.A., our lead real estate attorney brings over 17 years experience in the foreclosure, mortgage and real estate field as well as 22 in the accounting field. Ms. Salcines has been helping homeowners in foreclosure for over 10 years and is available by email to answer all your questions and concerns, without ever charging a consultation fee.

Call us today to set up an appointment to discuss your purchase or sale. We are here for you!
